Building a fence
Generally, if you want to build a fence on a common boundary, or upgrade an existing inadequate fence, you are entitled to do so as a property owner .
For the replacement of an existing fence, consult with your neighbour prior to replacing. If you wish your neighbour to contribute to the cost of the fence whether new or replacing the existing you will need to discuss this with your neighbour prior to the construction of the fence and seek agreement on the type of fence, its construction and the cost. If you and your neighbour are in agreement, it is wise to put in writing what is agreed upon and both sign it.
It is normal for cost to be shared equally for a realistic proposal but you have the ability to arrange a different option.
If you cannot reach an agreement then you may have to progress issues under the Fencing Act 1978. Section 10 of the Act sets out how you can get your neighbour to contribute to the cost of an adequate fence.
Are consents required to build a fence or wall?
District plan requirements vary from area to area for both the size and design of a fence or a retaining wall. You should contact us to check for the specific height restrictions and design requirements for your local area and if a resource consent is required.
Generally only fences over 2.5 metres will require a building consent.
