Many people overlook the need for a building consent when constructing a retaining wall. However, it is likely that you will need one.
Earthworks, particularly involving retaining walls and excavations, have the potential to result in land instability. As with any building work, the Building Act and the Building Code are legally binding and if you breach them or don’t obtain a building consent you may face penalties. In addition you, as property owner, will be responsible for any damage that occurs to neighbouring properties as a result of the work undertaken on your property.

Depending on the scale and nature of your proposed earthworks and the height and location of your proposed retaining wall, you may require a building consent, resource consent, certificate of compliance, or a combination of these.
