Proposal to revoke the reserve status of part of Long Bay Beach Road Reserve

​Auckland Council invites submissions or objections from persons with an interest in the Long Bay Beach Road Reserve, situated at 1045 Beach Road, Torbay.

Pursuant to section 24 (2) (b) of the Reserves Act 1977, Auckland Council hereby notifies its intention to seek the approval of the Department of Conservation to the revocation or uplifting of the reserve status over the land parcel described below.

Long Bay Beach Road Reserve is legally described as Lot 3 DP 78206. The reserve is partially occupied by the Sir Peter Blake Marine Education and Recreation Centre (marine education and recreation activities).  

The centre and its activities have been supported by both Auckland Council and the Hibiscus and Bays community for many years. The land is a classified esplanade reserve which does not provide for the centre's building or their activities on the land. Consequently, revocation of a part of Long Bay Beach Reserve is required to legalise the centre's facility and activities.

The proposed revocation will only affect a portion of the reserve, identified as Section 1 SO 522319 and comprising 2370 square meters. This portion consists of the western part of the reserve and contains the centre's building. The remainder of the reserve, comprising of 9865 square meters, will not be affected and will continue to hold its existing reserve status.

Revoking or removing the reserve status of Section 1 SO 522319 is the most practical solution to resolve the non-compliance issue.  Once revoked the land will be held by Auckland Council under the Local Government Act 2002.

Under the 2002 Act, Auckland Council can then grant the required leases and/or licences to the marine education and recreation centre. The council would like to reassure interested parties that none of the existing activities on the reserve will be threatened by the revocation proposal but will rather enable these activities to continue in a legitimate fashion, undeterred and to the benefit of the community.
