Rates remission (reduction) for natural areas protected in the former Franklin District

Wāhi taketake i rāhuitia e te Takiwā o Franklin o mua

The policy aims to promote the protection of natural areas of land including: native bush, wetlands, wildlife habitats, and land forms that have, voluntarily, been appropriately physically and legally protected or classified.

Eligibility and criteria

  1. We can grant this relief only while the necessary physical and legal protection remains in force.
  2. We can grant up to 100 per cent rates remission (reduction) for appropriately protected natural areas. We will determine the amount of relief on a case by case basis. Each application for rates relief needs to have enough information to allow us to assess:
    1. the significance of the natural area being protected. In particular:
      • the significance of the area in an international, national, regional or local context
      • the rarity or representativeness the area represents
      • whether the type of feature contained in the area has been protected elsewhere in the district of the previous Franklin District Council
      • the vulnerability of the natural area being protected, including an assessment of whether, and to what extent, the preservation of the natural area might be negatively affected if rates relief is not granted
    2. the financial cost and loss of opportunity for you in protecting the natural area on a voluntary basis
    3. whether you will need to change the use of the land and be bound by certain management practices and the likely costs involved
    4. whether unusual conditions and restrictions apply to the natural area being protected and surrounding land. If so, how these will affect the saleability and future use of the natural area and surrounding land
    5. any other matters we consider relevant. 
  3. The actual amount of rates remitted (reduced) in respect of the land containing a protected natural area shall be calculated using the following formula:
  4. Amount of rates remitted

    ​= (percentage of rates relief granted)​x

    ​(area of protected natural feature)
    (total area of property)

    ​x​(general rates and roading rates payable on total area of property)

    We may stop the rates remission or relief if you:

    • fail to maintain the necessary physical protection
    • breach the conditions of legal protection for a natural area.

    We will take this action only if other remedies, including consultation with you, fail. Rates relief for the protection of natural areas under the policy will not apply to protected natural areas included in a lot which has arisen out of a subdivision consent we issued. There is no fee for processing an application under the policy.
