When you can apply for a Deemed Permitted Boundary Activity

If your building activity or project is close to a boundary, and you have the neighbouring owners' written approval, you may apply for a Deemed Permitted Boundary Activity. This application replaces the need to apply for a resource consent for your proposed activity. You may still need to apply for a building consent.

If your boundary is next to a driveway, you will need to get an approval from the neighbour on the other side of that driveway.

When you cannot apply for a Deemed Permitted Boundary Activity

You cannot apply for a Deemed Permitted Boundary Activity if you are building close to a public boundary. A public boundary includes a boundary with any of the following:

a public road or walkway
a public open space
a stream, river, or lake
the coast
an esplanade reserve or strip
any other reserve
any land owned by council or the crown (e.g. public schools).

What you need to apply for a Deemed Permitted Boundary Activity

In order to apply for a Deemed Permitted Boundary Activity, you will need to:

supply signed site plans, drawings and designs for your proposed activity or project
supply a neighbouring owners' written approval, and
specify your email address in your application.
complete and upload a declaration form (unless you are an approved credit account customer).

All processing costs of this application will be charged to the building consent.

If this is a standalone application, a deposit will be required.

How to apply for a Deemed Permitted Boundary Activity Notice

We only accept online applications for a Deemed Permitted Boundary Activity Notice. If you are unable to apply digitally, visit one of our libraries with council services for assistance in making your online application.

What happens next

We will process your application in 10 working days.

A planner will contact you by email and let you know if you have provided the correct information.

If you have, we will approve your application and issue the Deemed Permitted Boundary Activity.
If you haven't, we will advise you what information is missing and you will need to re-lodge the application.

You cannot appeal or object the decision.
