Proposal to promote a local bill to amend the leasing powers within the Auckland Domain Act

​Auckland Council is looking to progress the promotion of a local bill to amend the Auckland Domain Act 1987 (Act).

The Act governs how Council manages the Domain.

Currently the Act prescribes the maximum term to named lessees at defined locations within the Domain. Once those terms expire, no further leasing of those sites is permitted under the Act. To enable further leasing an amendment to the Act via a local bill would be required.

The Auckland Domain Committee resolved on 19 May 2025 (ref ADCCC/2025/13) for staff to progress with public consultation engagement on the proposal to amend section 7 (leasing) of the Act.

The proposal being consulted on is to promote a local bill to amend the Act to empower Council to grant future leases only at the same locations currently defined in the Act. Groups and tenure would be at Council’s discretion, subject to the consultation requirements under section 138 of the Local Government Act 2002.

Following mana whenua and public consultation, staff will present these findings to the Waitamāta Local board. Staff will report all findings and views to the Governing Body. The Governing Body will then consider a recommendation that Council propose to Parliament that the Act be amended.

Once Council has taken into consideration all feedback and elected members preference the exact nature of its intended proposal will be further consulted on via Parliamentary Standing Orders.
